Terms and Conditions for the Sale of Air Tickets

This document is available in Polish and English. The Polish version is the legally binding one.

These Terms and Conditions set out the rules for intermediation in the sale of air tickets by MY MAGIC TOUR Sp. z o.o. Please read them before making a booking.

    I. General provisions

    1. Air tickets are sold by MY MAGIC TOUR Sp. z o.o. (limited liability company) with its registered office in Osielsko (86-031) at ul. Centralna 12A, KRS 0001132811, NIP 5543029358, REGON 529923206, hereinafter referred to as the "Agent".
    2. The Agent acts as an intermediary in the sale of air tickets on behalf of and for air carriers.
    3. The contract of carriage is concluded directly between the Passenger and the air carrier.
    4. The conditions of carriage, check-in rules, baggage rules and carrier liability are governed by the conditions of the carrier operating the flight and the applicable international conventions (including the Montreal Convention and the Warsaw Convention).

II. Booking and purchase of a ticket

    1. A ticket booking is made on the basis of an inquiry sent by the Customer electronically, by phone or in person.
    2. The Customer is required to provide details matching the identity document (passport) used for travel: first and last name, date of birth, nationality, document number and expiry date.
    3. The ticket price is valid only until the ticket is issued. Until the booking is paid for, the price and seat availability may change in accordance with the carrier's fare rules.
    4. The ticket is issued once full payment has been credited to the Agent's account or the payment has been accepted through the online payment system.
    5. The Customer receives an electronic ticket (e-ticket) at the e-mail address provided.

    III. Payment

    1. Payment for a ticket may be made by bank transfer, payment card or through the available online payment system.
    2. The ticket price may include the Agent's service fees, the amount of which is communicated to the Customer before the ticket is issued.
    3. A VAT invoice for the service fee is issued at the Customer's request.

    IV. Changes and refunds

    1. The possibility of making changes to a ticket (date, route, Passenger details) or obtaining a refund depends on the fare applied by the carrier.
    2. Most air tickets in promotional fares are non-refundable and non-changeable. Detailed fare conditions are provided to the Customer before purchase.
    3. Changing Passenger details (first name, last name) after the ticket has been issued is in most cases not possible - a new ticket must be purchased.
    4. For refundable tickets, the carrier's fees and the Agent's service fee are deducted from the amount refunded.
    5. Processing a refund on the carrier's side may take up to 8 weeks from the date the request is submitted.

    V. Check-in, baggage and documents

    1. The Passenger is required to arrive at the airport sufficiently in advance in accordance with the carrier's recommendations (usually at least 2 hours before a domestic/European flight and at least 3 hours before an intercontinental flight).
    2. The Passenger is responsible for holding a valid passport, any required visas, health certificates and other documents required in the destination and transit countries.
    3. Baggage limits (checked and carry-on) are set by the carrier. Information is available at the time of booking and on the carrier's website.
    4. The Agent is not liable for a Passenger being refused boarding due to a lack of required documents, being late, or failing to meet the carrier's conditions.

    VI. Liability

    1. Performance of the contract of carriage, including cancellation, flight delay, or loss of or damage to baggage, is the sole responsibility of the air carrier in accordance with applicable regulations (including Regulation (EC) No 261/2004).
    2. The Agent undertakes to correctly issue the ticket in accordance with the Customer's instructions and to provide all relevant information regarding the fare and conditions of carriage.
    3. The Agent is not liable for schedule changes, delays, flight cancellations or the consequences of such events.

    VII. Complaints

    1. Complaints concerning the performance of carriage (delay, flight cancellation, baggage) should be directed straight to the carrier operating the flight.
    2. Complaints concerning the Agent's activities (e.g. incorrect issuance of a ticket) may be submitted to: hello@mymagictour.com.
    3. The Agent handles complaints within 14 days of receiving them.

    VIII. Right of withdrawal

Pursuant to Article 38 point 12 of the Act on Consumer Rights, the right to withdraw from a distance contract does not apply to the Consumer in respect of contracts for the provision of carriage services if the contract specifies the date or period of performance of the service. This also applies to air tickets.

    IX. Personal data

The controller of Passengers' personal data is MY MAGIC TOUR Sp. z o.o. Data are processed for the purpose of performing the intermediation agreement and are transferred to air carriers and global distribution systems (GDS) to the extent necessary to issue the ticket. Details can be found in the Privacy Policy.

    X. Final provisions

    1. Matters not regulated by these Terms and Conditions are governed by Polish law and the carrier's conditions.
    2. Disputes arising from the agreement are resolved by the court having jurisdiction over the Agent's registered office, and in the case of Consumers - by the court having jurisdiction under the general provisions.
    3. The Consumer may make use of out-of-court methods of dispute resolution, including:
      • mediation at the Provincial Trade Inspectorate,
      • assistance from the municipal/district consumer ombudsman,
      • the ODR platform: ec.europa.eu/consumers/odr.
    4. These Terms and Conditions apply from 1 December 2023.
